New Zealand Right to Work Process

The Work Entitlement New Zealand (NZ) check is built to ensure organisations meet their obligations to verify that every worker is legally entitled to work in New Zealand by confirming citizenship or performing a VisaView check using foreign travel documents. The check captures information for three different Citizenship types:

  • NZ Citizen

  • AU Citizen

  • Foreign Citizen

This allows for the verification of identity and for foreign citizens their entitlement to work in New Zealand through VisaView NZ.

Using our MyCheck employee document collection workflow, it's easy to initiate Work Entitlement checks for employees in New Zealand, cite id evidence, complete VisaView check if applicable, and report on work entitlements for your organisation.

Completing the Work Entitlement New Zealand (NZ)

Once the Work Entitlement New Zealand (NZ) check is enabled in your account by the CheckWorkRights team, and your employees are in the system, you can send the employee a customisable email to their MyCheck Dashboard where they can begin their work entitlement check process.

Once the employee submits all documents, a designated verifier is notified by email. The verifier will review the id documents submitted by the employee and accept or reject the document.

Once the ID documents have been verified, (Verifying and Reviewing Documents) a VisaView check will be required for anyone identifying as a foreign citizen.

Step 1: Enabling the Check and Emailing the Employee

From the employee profile, select Enable Employee Completion on the Work Entitlement New Zealand (NZ) tile.

After enabling the checks you can send the employee an email immediately using the Send MyCheck Email button, otherwise the email will be issued automatically on a schedule until the employee the completes the Work Entitlement New Zealand (NZ) check.

This check can also be enabled automatically via CheckIntelligence or other existing integration workflow.

Step 2: Employee Completes the Check

The Candidate/Employee will receive a request to complete the Work Entitlement New Zealand (NZ) check with a link to their MyCheck dashboard, MyCheck Email Workflow Explained

The employee follows the link and provides their consent for CheckWorkRights and their employer to handle their personal information for the check. They will then be guided to select one of three options confirming their citizenship status, New Zealand Citizen, Australian Citizen, Foreign Citizen.

The following documents are acceptable for verifying work rights:

New Zealand Citizen

  • New Zealand passport

  • New Zealand birth certificate plus a form of photo ID

  • New Zealand citizenship certificate plus a form of photo ID

Australian Citizen

  • Australian passport

Foreign Citizen

  • Foreign passport

  • Refugee Travel Document

For a foreign citizen, during this process the Candidate/Employee will consent to the Employer completing an initial VisaView check and ongoing for the life of their Employment.

Step 3: Employer verifies the check results

Once CheckWorkRights receives the result, the designated verifier (line manager or HR manager as identified during account setup) will receive an email from CheckWorkRights to complete the verification process. Users can also visit the Document Verification area on the CheckWorkRights Dashboard or employee profile to locate the employee's evidence.

The verifier views each returned document, confirms that the document matches the employee's name and can Accept or Reject the result based on the information present.

Once ID document/s are verified for foreign citizens a VisaView check is required to validate the employees right to work in New Zealand.

Step 4: Complete VisaView Check

Once identity documents are verified, a VisaView check is required to validate the individuals working rights in New Zealand and record the outcome by following the prompts.

Log in to your organisations VisaView account at https://visaview.immigration.govt.nz/. Enter the Candidate/Employee information and submit. Once the result is returned, complete the results fields in CheckWorkRights to log the verification of working rights, your search will return information that will allow the fields to be populated, allowing for auditing.

Upload proof of the VisaView check, the verifier needs to upload a screenshot or PDF proof of the VisaView check they complete, once the result information and VisaView evidence is filled in, the ‘Complete’ button will be highlighted for the verifier to complete the validation process.

Green - Verified New Zealand, Australian Citizens or Foreign Citizens with no Visa Restrictions

Yellow - Employees with Visa Conditions limiting employment

Red - Foreign Citizen with no working entitlements or no valid VisaView result returned

The Critical Summary report Highlights Visa’s that are expired, Unable to check, Refer to immigration or No working rights.
