Visa Holder Lifecycle Management Tools

An overview of available features to manage WHMs and Student Visa holders throughout their employment.

Once Working Holiday Makers (WHMs) and Student Visa holders have completed their initial right to work checks, their visa subclass and applicant information will be displayed on the employees tab.

Student Visa Holder - Primary (Condition 8105)

Primary student visa holders are subject to Condition 8105, which limits when and how much they can work.

  • They can work up to 48 hours per fortnight while their course is in session (a 14-day period starting on a Monday).

  • They can work unlimited hours during official course breaks, or if their course is completed, cancelled, or deferred.

  • Students in a Master’s by Research or PhD can work unlimited hours at any time.

  • They can’t start work until their course has officially commenced.

  • The 48-hour cap applies across all jobs, not just one employer.

Student Visa Holder - Secondary (Condition 8104)

Secondary student visa holders are subject to Condition 8104, which limits when and how much they can work, dependent on the primary visa holder's start date and course type.

  • Most secondary visa holders can work up to 48 hours per fortnight, the same limit as primary student visa holders.

  • Unlike primary students, they can’t work full-time during study breaks.

  • If their partner is enrolled in a master’s by research or PhD, they can work unlimited hours.

  • They can’t start work until their partner’s course has officially commenced.

Working Holiday Maker (Condition 8547)

Condition 8547 restricts Working Holiday visa holders (subclass 417 or 462) from working for the same employer for more than 6 months. Exceptions may apply in certain sectors or if the worker changes locations within the same organisation.

From 1 January 2024, Working Holiday Makers (WHMs) can work for the same employer in Australia for more than 6 months without asking permission from Department of Home Affairs (DHA) if they work in any of the following:

  • Different locations for the same employer, as long as work in any one location (including working from home) does not exceed 6 months, or;

  • Specified regional locations and industry sectors.

With CheckWorkRights’ Working Holiday 6-Month Management, employers can record an employee’s start date and location. CWR then tracks the 6-month period, sends alerts when action is needed, and allows the timer to be reset if the employee moves locations.
