Collecting Secondary Student Visa Holder (8104) Relationship and Exceptions Evidence

Secondary Student Visa holders can submit relationship evidence to confirm work rights and relevant exceptions.

Using this process in CheckWorkRights employees can submit documents via their MyCheck Dashboard to verify their relationship to a primary student visa holder and demonstrate eligibility for work hour exceptions. The secondary visa holder provides a confirmation of enrolment to indicate the course start date and the course type studied along with relationship evidence documentation, such as a visa grant notice or marriage certificate.

A CWR Account User can filter by visa condition to view a list of employees who have condition 8104 attached to their visa, to see which employees this applies to.

Employee Submission Process

With this check enabled, employees with condition 8104 will receive an email prompt from MyCheck every three days until they upload relationship evidence for your team to review. You can also share the MyCheck Dashboard URL directly with your employees.

To view a list of employees who have yet to submit their relationship documentation, use the Work Entitlement filtering options:

Filtering > Work Entitlement > Secondary Visa Holder Relationship Evidence > Awaiting Employee > Apply Filter.

You can initiate a MyCheck email reminder from an individual employee’s profile using the Send MyCheck Email button, or in bulk from the Employee list via Make Bulk Changes > Send MyCheck Email.

The employee can then access their MyCheck Dashboard via the email or link provided.

Employee Upload Evidence Steps

This check allows a student visa holder with condition 8104 to declare their relationship to the primary visa holder and upload evidence of the primary visa holder’s course type and commencement date to support exception requests.

  1. They answer the following question to determine eligibility for a work hours exemption:
    Is your family member enrolled in a Masters by Research or Doctorate/PhD course?

  2. They upload their Confirmation of Enrolment document, which must include the primary visa holder’s course details, commencement date, and the education provider’s name.

  3. They enter the course start date.

  4. They upload evidence confirming their relationship to the primary visa holder. This may include:

    • Marriage or civil union certificates

    • De facto relationship registration

    • Visa grant letter showing both names

    • Birth certificates for dependent children

  5. They review and confirm their documents, then click Submit.

  6. Once submitted, the documents appear on your CWR dashboard marked in yellow, ready for verifier review.

Verification

The designated verifier (e.g., a line manager or HR representative) will be notified via email to review and verify the submission.

They can also verify the document through:

  • The Document Verification section of the CWR Dashboard

  • The mobile app

  • The web application

The verifier reviews each document against the verification guidelines, confirms the details, and then either Approves or Rejects the submission.

If approved, the employee’s verified relationship information and any applicable work hour exceptions are added to their work entitlement record in the CWR system. This appears on the dashboard under Supporting Evidence – Secondary Family Member.

If a submission is rejected, the employee is automatically notified and prompted to resubmit the required information.

On the dashboard, secondary visa holders are grouped by status:

  • Green means the employee has submitted relationship evidence, the associated primary visa holder has started their course, and the secondary holder has approved evidence for a work hours exception. They’re cleared to work unlimited hours.

  • Yellow means the required evidence has been submitted, but the employee does not qualify for an exception. They are still restricted to 48 hours per fortnight.

  • Red means the employee hasn’t provided the necessary documents to confirm their right to work, or the relevant course hasn't started yet.
